Commissioner urges residents not to violate building permissions
JAMMU, JULY 28: A demolition drive was carried out by the Jammu Municipal Corporation (JMC) today during which an illegal construction in Sainik Colony was dismantled by the Enforcement wing of the Corporation.
As per JMC, the construction was being raised in Sector-D, Extension of Sainik Colony without any permission from the competent authority as reported by the concerned Enforcement Inspector.
Accordingly, notices u/s 7(1) and 12(1) of J&K Control of Building Operation Act, 1988 vide No: JMC/CEO/03/1/2021 dated: 31-05-2021 and No: JMC/CEO/03/2/2021 dated: 31-05-2021 were served to the owner to stop unauthorized construction and to show cause within 48 hours from the date of the notice as to why the Khilafwarzi/violation should not be sealed/demolished.
A JMC spokesperson said that since no response was received from the owner within the stipulated time, another notice u/s 7(3) of J&K Control of Building Operation Act, 1988 vide No: MJ/CEO/03/3/21 dated: 08-06-2021 was served to the defaulter to demolish the construction/violation within 5 days from the date of the latest notice failing which the same will be demolished by the Jammu Municipal Corporation at the owner’s risk and cost.
The spokesperson said that on 16th June 2021, it was reported that, despite being cautioned through repeated notices, the defaulter has started the slab laying work of the illegal construction which was immediately stopped through the Enforcement staff of JMC. “Meanwhile, the time given to the owner for demolition of the illegal structure u/s 7(3) of J&K Control of Building Operation Act, 1988 through letter No: MJ/CEO/03/3/21 dated: 08-06-2021 had also lapsed and no reply was received from the owner,” he said.
“Accordingly, on the approval of the Commissioner, Jammu Municipal Corporation a demolition drive was carried out on 17th June 2021,” he said and added that however, it was brought to the notice of the JMC authorities through media reports dated: 17-07-2021 that the Khilafwarzi/violation demolished by JMC in Sector-D, Extension, Sainik Colony has been raised again.
The spokesperson said that on the same day the concerned Enforcement Inspector was asked to submit a report regarding the current status of the said construction within two days and explain his position regarding the repeated Khilafwarzi/violations. “The Chief Enforcement Officer was again directed to serve notice to the owner for violations u/s 7(1) of COBO Act 1988,” he said and added that since no reply was received from the owner within the stipulated time, a notice u/s 7(3) of J&K Control of Building Operation Act, 1988 vide No: MJ/CEO/03/3/21 dated: 23-07-2021 was served to the defaulter to demolish the construction/violations within 5 days from the date of the fresh notice failing which the same will be demolished by the Jammu Municipal Corporation at owner’s risk and cost.
However, after the owner failed to comply with the notice served by JMC, a demolition drive was conducted on the instructions of the Commissioner, JMC today and the illegal construction was dismantled.
Commissioner JMC, urged the emancipated residents of Jammu city not to raise any constructions in violation of the building permissions. She said no violations in sanctioned building plans will be tolerated and the number of permissions issued in every ward needs to be kept constantly under the watch so that no deviations are allowed at any cost.
